Don't see a real problem...
As long as judges are following existing rules. It's not reasonable to expect judges to pretend that the only relevant information on a case is what the litigants choose to present; after all, trial lawyers tend to be more concerned with winning and strategy than seeing to it that justice is done (that's the judge's job).

It's probably a good idea, however, to allow the litigants to comment on whatever the judge finds before a final decision is made.
