DMCRA, Are we lucky?

Wow! So Rep. Butch Otter considers theft to be theft and property to be property.

Well Butch, try this idea. A program that allows a person to use a product that he/she legally purchased is a valuable property in its own right. A law that prevents the inventor of that program from selling it is theft of that person's right to recover the profit that he/she is due.

Jack Valenti and his cohorts do not want to protect their property. If they did then they would lock it up and keep it hidden. What they are trying to do is to control the property after they have sold it. In effect they are in violation of the "first sale" doctrine that has been upheld in many courts of this land. The DMCA violates this doctrine by prohibiting the purchaser of a product from treating the product in a manner that he/she desires.

Please note, Rep. Otter, that the prohibition in the copyright law which existed prior to the DMCA preventing the purchaser of the product from selling copies remains intact even with the full repeal of the DMCA. Repeal of this bad law will simply place the responsibility for protecting their copyrights back upon the copyright holders and require them to use the courts as intended, rather than allowing the courts to be bypassed.

The Digital Media Consumers' Rights Act should be a one sentence act. It should state: "The law known as the Digital Millennium Copyright Act is hereby repealed in total." You could optionally include a complete pardon for anyone who has been convicted under any provision of the DMCA.
