OOXML isn't open
Microsoft is trying to pass along OOXML as "open" when it is not. It's got the same restrictions as always with a "pledge" they won't sue. But this pledge isn't legally binding and if someone implemented it and that software was more popular than Microsoft Office, what keeps Microsoft from crushing them?

It's also developed by Microsoft as a proprietary format and then they "opened" it later. It wasn't developed by a consortium, and nobody can add to the spec except Microsoft.

If Microsoft actually helps develop an open format, this would be a great step, but OOXML is not open at all.
