Maybe not. An Australian judge allowed a lawsuit against a U. S. company because he considered the U. S. company's internet news report about the Australian company to be an Australian presence.

U. S. Judges have allowed suits against non-nationals in other matters when the non-nationals were never in the U. S.

"DVD Jon" who was sued in Norway by U. S. multimedia companies for violation of the DMCA. I believe that that was decided on Norwegian law though.

I agree though that this would just be a confirmed list of recipients, and I'm not sure the trouble would be worth the result.
