it is about a bad patent that should never have been issued

The patent was wrongfully issued if it was not original, non-obvious, or the applicant never had an intention to reduce it to use. From what I read here, the challengers submitted evidence challenging the originality of the invention. Best I can tell, UC is bringing some earlier documents to verify the originality (the invention, not the filing date, would prevail). Curious though, there doesn't seem to be a challenge on the basis that UC did not implement - seems to me if they had the infringement would have been evident much sooner. Maybe this is something that is harder to prove.

While I agree the patent might be harmful, the question of whether it should never have been issued seems to be up in the air.
