Hafta disagree on one point

However, Microsoft DEFINITELY has the resources to patent search despite the difficulty involved.

While on the surface, your logic should prevail, in reality it is nigh unto impossible to do a thorough patent search in software. Difficult in other arts, but software really sucks.

Our technology is evolving rapidly. Not only are we confronted with ever new terms, but also with what we call things migrates as technologies mature. So you are confronted with the unenviable task of guesing every search term that might have been used by any applicant at the time of the incipient art, you are also faced with the prospect that the claim you are infringing might be one that the applicant considered minor at the time of application.

This stuff is horrendous. I know a lot that is wrong with the system, but don't have a good suggestion as to how to right it.
