Well...
As there are a kazillion patents in existence it's not an easy thing to do. There needs to be a better way of seeing if you break a patent or not.

However, Microsoft DEFINITELY has the resources to patent search despite the difficulty involved.

More to the point of "ambushing" people later. The closed source model makes it very hard for a patent owner to know if their patent has been infringed on. Do you expect Microsoft et al to disclose publicy how they are doing things? How often have they ever done that?

You expect people to defend their patent from day one when they can't see if someone has actually hijacked your IP? How?
