I disagree ...

It's too bad that Microsoft looked didn't do their due dilligence and verify that the technology didn't infringe on somebody else's patent. Since they didn't do this, or decided to ignore it, they are in the situation of violating it.

You also claim that you can't let people use a technology for years, then charge money for it. If that's the case, then patents should only be valid for a few years at a time. What you're suggesting is that if I rob a bank, but don't get caught within a few months, I should go free. I suspect that the patent sat in somebody's dusty drawer for years before somebody else discovered it.

Either way browsers infringe on the technology, and are liable to pay regardless of whether you like it or not.
