Hard to call

From what I read here, it seems as if Eolas is claiming it has documentation that might pre-date the prior art that has been cited? The U.S., as contrasted to Europe and Japan, is a "first to invent" jurisdiction, so if the Eolas founder can show that his invention is prior to the other examples, he is entitled to the patent. Does anybody understand the Eolas case better than my read on this article?
