Sorry, I think you have this one backwards. As far as I can find,
Real never filed an antitrust suit against Microsoft in the United
States, until after the EU had already made their decision:

So clearly Real got the verdict they wanted in the first place, and
then went on to file their own suit to take advantage of it. This
is a far cry from failing in one court, and running to 10 other
courts to try to get a different verdict.
