After reading the proposed license I don't see what the big deal is.

It's all about protecting freedom for all. The terms are acceptable in exchange for being able to use free software. Those who don't wish to obey the terms of the license shouldn't use it. If Tivo wishes to take advantage of the work of others to run on their boxes then they too should abide the license. Those who don't are free to use a proprietary alternative or write their own software.

If a company or any other entity chooses to enter into patent agreements protecting their users of GPL'd software then that protection necessarily should cover all users across the board.

Again those who don't wish to comply are free to license or write their own proprietary software.

The trade-off is more than fair for any "Linux company". Novell for instance now bases their business on GNU/Linux. The vast majority of what Novell offers was not vreated by Novell. The least they can do is abide the license and the spirit and intention of same.
