Two possibilities
They are really stupid, or in a position where if they admit that there is no case then they are sure to loose all their money. They know SCO can't make it selling software, so the only choice is to hope for some luck with a hopeless case. They also don't want to make it look like they made a bad choice or people will lose faith in them. The only choice they have is to pretend that SCO can win.

I guess if you are one of those conspiracy people, you might say that the whole baystar thing was a sham and that 50 million was just play money used to damage Linux. Think about it, 50 mil is nothing for gates and crew to lose, but it would (and did) go far in tarnishing Linux.
