I recognize the "could"
Just don't agree that this would be a good move. IBM has crafted a top-notch image over the past 15 years or so, and this would be more like wrestling with pigs. How does it go? You end up dirty and the pig ends up with a smile on its face? While you may have a gut reaction that such thing would make IBM look like a good guy, I think it would make the company look vindictive and less-than-objective. Unless some really compelling evidence came to light, I would say move on.
