The lawyers are getting paid one way or another, so if they think they have a case probably isn't as much a motivation for them. There are many reasons SCO might have done this. Personally I think they probably thought IBM would buy them to shut them up. Could have been a stock scam too. Certainly suckered Baystar and made all those people who sold the stock in the teens some cash. Nothing they have done shows any interest in resolving the case in court. They've actually gone though a lot of trouble to avoid the court room, which tells me they never had or thought they had a case.
