You are missing something...
Novell retained certain rights to UNIX, specifically the right to wiave on SCO behalf - which they did for IBM. Thus, Novell used their UNIX rights to waive SCO's claim on the UNIX source code in Linux for IBM on SCO's behalf.

Kinda puts a damper on SCO's lawsuit, having your claim waived on your behalf...
