That's the point of the appeal
The issue is that the Consent Decree does not actually do anything to rememdy the situation as it exists in the market today.

Microsoft has and retains a monopoly in the desktop OS market. Some steps have been made in requiring uniform OEM licensing but MS is already finding loopholes around that. The "Set Program Access and Defaults" solution is a practical no go and we're seeing that new MS services are ignoring it as well. (Read about their music service offerring.)

If you read the trial transcripts and data from the Findings of Fact you'll see such interesting points as the fact that MS was willing to cut off the then #1 OEM PC seller in order to promote IE over Netscape and the fact that a frustrated HP engineer wrote MS saying that if they had had any alternative then they wouldn't buy Windows.
