a spam filter does not throw up an advertisement based on the email's content. and a spam filter only looks at predefined parts of an email that are common to spam.

and just because someone can read my email does not mean they have a legal right to and make it public.

and the subscriber may agree to the terms but i will not and therefore will object to sending mail to a gmail account. implied consent may be in force here but you will find that it is not legally defensible.
