Does Gmail breach wiretap laws?

You have no expectation to privacy: When you send an email there is no expectation of privacy.

You don't have to consent over what I do with email arriving in my email box. If I want to give up personal info arriving in my email box I can do that and you can't stop. You can choose not to send me email though.
