They patented mice
Personally I doubt it would stand if it's a tree directly out of nature. Even cross polination to produce differnt breeds shouldn't not be patentable. I don't think you can patent dog breeds so why can you pantent flowers this way? It's natures design not anyone elses. Just goes to show how stupid patents are these days.
