It's a very flawed law
The DMCA isn't supposed to have anything to do with copyrights. The law is there prevent you people from creating anything, be it code or hardware, that has sole purpose of defeating anti-copying protections. Just because anti-copying protection are protecting copyrights does not mean this law is about copyrights.

Those emails are under copyright protection just any email written is. Now if you copy those emails and post them on a web sight that is copyright infringement. How does a link to the copyright protected email that is being infrigned on break any copyright protections?

This just shows how flawed the DMCA is. It can be used many other ways that were not intended. This one of them and the RIAA avoiding due process is another one.

Personally I don't see what they intend to gain by this move except maybe demonstrating why the DMCA needs to be re-written.
