Washington wakes up to spyware, adware

Hmmm, These politicians wish to punish spyware authors, not the users of the spyware or those who misuse the collected information. They also wish to override stronger state laws.

Wrong on both counts. The penalty for using spyware should be double that for writing it. States should be expressly allowed to pass those laws in this area which they determine necessary, and the stronger law should be used for prosecution of the violators.

"That would void Utah's recent anti-spyware law and address the concerns of software industry lobbyists, who worry that companies would have to abide by a patchwork of ambiguous and poorly drafted state regulations."

The solution of avoiding entanglement in ambiguous and poorly drafted state regulations would be no worse that avoiding ambiguous and poorly drafted federal laws. It's not really difficult. DON'T SPY!

Inslee seems to have a better idea, maybe. The behavioral approach is definitely the correct way to go. It is similar to making someone stop living. It doesn't matter if you use a gun, a knife, a ball bat, a scythe, a pitch fork, or a car. the end result, that someone is dead is what is to be avoided. HOW is not relevant.

"Inslee promised that his approach would avoid some of those pitfalls. "The biggest difference is the approach of how we would define a resolution of this issue," he said. "After really looking at the technologies involved, we think the best approach is to deal with behaviors and transmissions of information rather than trying to identify types of software. We think that would be a superior approach. If you address it by looking at types of software, you could end up banning beneficial uses.""
