They do...
It's part of the EULA. They purposefully bury it in the fine print that hardly anybody reads anyway, so they can sneak it by the users. And once you accept it (which is required to install the software), then the company distributing it is indemnified against anything the scumware does on your computer.

Of course, you practically have to have a law degree to understand some of those EULAs anyway.
