i would...
actually take it one step further and make all of the cases that might affect subsequent ones be done first.
1) SCO vs. Novell; they should legally prove they do own the rights and the ability to enforce them, before they are allowed to proceed with anything else.
2) SCO vs. IBM; if they do own such rights to Unix, then they should need to prove that IBM did infringe those UNIX rights by copying into Linux.
3) RH vs. SCO... is a pointless case if either of the above cases fail to side with SCO
4) SCO vs. Autozone... same as the RH case.
