The point is...
...that it can be part of the kernel. That's the great thing about Linux--if you don't like how the kernel is working, change it. Granted, it's not all that easy--kernel coding can be tricky, if only because it's not all that observable in debug--but with a hot-button issue like DRM, I guarantee that any attempt to impose real DRM on people will be very neatly sidestepped.
