Not. Note the tone of JA's statement contrasted with Lowry's statement, which just "wished him the best". JA would have Novell break contract with M$, even though it does not legally violate GPL v2. Breaking legal contracts (without that being provided for in the contract and barring some legal grounds...for example, failure to obtain regulatory approval, etc.) is not ethical.
