If an entity shows the source, but in some way forbids me from distributing such, unless I sign a separate waiver or receive code only from them, then they do not fit either the letter or spirit of the Open Source Definition (let alone the Free Software Definition). OpenOffice.org (OOo) is Free Software. Downstream distibution in perpetual entity relationship is required by both the OSD and FSD. Since the source of Novell's contribution may be contaminated by Microsoft patents and Microsoft will not license distribution rights to third generation downstream receivers; the result is not an Open Source contribution.

All the way Open or all the way Closed. "Take a peek", "look, but don't touch." "Touch, but don't distribute." are not Open Source.
