You are correct
It is up to the owner of Intellectual Propery if they wish to release it under opne source. In some cases this is very complicated because of various contributors (as was stated.)

Look at all the gymnastics Sun goes through with its "Open Source" Solaris.

The fact is, Operating System in the Unix league do add value beyond what can be derived from Open Source variants like Linux. It's not that Linux is BAD, but there is a huge financial incentive for the owners of proprietary Unix versions to make them MUCH better than "free" counterparts.

Customers are willing to pay for these features, just as they are willing t pay exorbitant support fees for the "free" Linux.

"Free" is nice, but few things in life truly are, nor do commercial enterprises expect them to be.
