There are several issues at hand:

1) Whether the judge failed to take into account the prior art claims.

2) Whether the prior art claims are valid.

3) Whether Eola's widely defined patent were correctly granted and whether they should be rebuked.

4) Whether the W3C's claims of IT dependence are enough to dismiss a case.

5) Whether the W3C's claims of IT dependence are enough to rebuke a patent.

6) Whether similar cases in the past should be a bases for this case.
