Yup, hence they are called a monopoly. If it looks like a
duck, sounds like a duck and walks like a duck, it's a duck.

I have no doubt they will either. But Bit (aka Ax) has made
a constant point about not pre-judging court cases (just
look at his SCO postings). Yet here he is basing his opinion
on a number of presumptions, none of which are yet fact.

And I wouldn't guarantee that any witnesses will be
called. It's an appeal, not a trial.
