This has nothing to do with the EU vs MS
The fact that Real is having to do a deal with either Apple or MS shows they are being driven from the market. The EU will not take action against Apple because they have not been shown to be a monopoly in any market. If Apple should gain dominance in a defined market (say media devices) and they are found by a court to be a monopoly then perhaps something may be done.

I don't think anyone sees this as a near-term prospect.

On the other hand, Microsoft has been proven to be a monopoly. Nothing has changed in the relevant market to remove their monopoly status; therefore, they are subject to anti-trust provisions that attempt to stop them leveraging their monopoly to control other markets.

Note that the EU action is against the market in which MS has their monopoly, that is, the PC operating systems.

You are also presuming that MS will appeal the EU decision (as far as I know, they haven't actually done it yet), that the appeal will be heard and that one party will call Real as a witness.

Quite a bit of presumption, eh?
