What's broken in this thinking is its not OSS that's shut out -
While what you suggest does provide a very limited work around, it does not allow it to be seen by "many eyes" or used by the open source community.

Things like data formats are actually used by the customers, they are supported by the vendors.

If MS precludes an OSS tool from pushing data into an MS app, or an MS app from pushing data into an OSS tool, how does that benefit either MS or the end user?

Look at it from the point of view of a State which has statutory obligations to safegaurd and archive data, what difference does it make what's on the other side of the interface - doesn't MS want Visio to be used as the visualization tool?

MS has to stop trying to limit interoperability or it will continue to create problems for itself. Use all the patents or licenses you want, the customers own the data not the vendors. Customers choose which vendors get to see the data, and MS still doesn't really respect this fundamental point!
