On OOo, yes... on StarOffice, no
Since StarOffice contains both proprietary and open code (and thus is sold as proprietary overall, but publishes what source code it legally can), Sun will be able to work around all that. So while people who use Linux are not necessarily shut out. If they absolutely need to use this XML format will be able to. People who use the free OpenOffice.org suite will be shut out, but then again I'd imagine most people who'd go for the free version would have no real need for an XML format, and those who do would either use OOo's native XML or bite the bullet and buy StarOffice.

Of course GPL programs that are not necessarily office suites would be excluded too. But if anything, MS would be shooting themselves in the foot for excluding these programs, because if enough of these type of programs gain traction, they may steer potential MS customers towards OOo XML simply for licencing reasons.
