it's not all black and white
Civil suits are not about right and wrong - they are about who has the better argument. In the software patent department the courts always seem to be a bit in the 18th century. I can go to the patent office and patent every color in the rainbow for every single pixel on the screen, and then drag everyone to court for not paying me royalties. Sounds far fetched right? Well, about 5 years ago a couple of companies tried just that - they were run by patent lawyers, not programmers or IT people - and they got within a hair of getting such a patent.

At some point it just ceases to be funny.
