Microsoft settles with Sun, AOL, and the others and enters complex deals to cross license and use patented technology as well as set high market values for that IP. They can afford to do that and have finally figured out how to swim in a new sea. By the time the litigations are all settled, MS will have spent maybe 12 weeks worth of profits to move to an unassailable position vis-a-vis potential future competition.

"Hey, it's not OUR patent blocking entry to our markets, it's soandsos and we had to pay $440M to be in this market!" Imagine RedHat and the rest paying $440M for patent rights to things that they will have to give away to only match the MS product offering. No can do.
