The ruling we're really waiting on
is whether the Courts ruling on "reasonable and non-
discriminatory" includes open source projects and the royalty
payable on patents over the specification not copyright.

The EC believe it should be open to all, and has concluded MS
has no IP value requiring royalties.

The EC agreed with MS that they'd wait for the Courts ruling
before enforcing their position. If the Court agrees with the EC's
position it would be enormously damaging to MS (watch the
share price tumble).
