It might work if...
...you go after the company the spam directs the recipient to, not just whoever is named in the message. If the spammer is acting as an agent of the company, the company is responsible for the spam, unless they can prove that they had no way of knowing what was happening. But if they have some system set up to respond to those directed messages, that seems unlikely. At the very least, the companies would be forced to require the marketers not to send spam and not to deal with any that do. If they fail in these respects, they can and should be held responsible. That won't stop spam sent by the company itself, especially if they are outside a country's jurisdiction, but it should help.
