How is he wrong?
He stated that it WASN'T in the Bill of Rights. It is also illegal for anyone to send unsolicited faxes. Broadcast ads are something else entirely, because being able to sell those ads are part of the satellite companies' business model and being able to broadcast them is part of the terms of service. Unless the ISP has an agreement with the spammers (not impossible), it is very different.
