Proof in UC Berkeley Case
The article feed on Zdnet fails to connect this case with the UC Berkeley Case which involves the way controls are displayed in a browser. Multiple courts have told Microsoft to pay the University of California and the current patent holder for the stollen code but Microsoft instead cripples both active X controls and Java Applets in its newer browser's with a notion that wrapping the control in a script somehow avoids the patent.

This is a big deal to the Web 2.0 kids who will find applets as a way to remove the refresh involved in Web 1.0 work and a way to deal with poor connections to the Internet.

Applet performance is choked when wrapped in a script as Microsoft instructs the kids. When not wrapped you get an awkward and unprofessional click to activate warning kind of like the warning about Dr DOS which came up in the last US Antitrust case. Other browsers such as Firefox work fine. I had hopes that the next flavor of IE would as well. But so far have not heard anything. I suppose I could load the new IE...

Anyway other feeds state:

"The high court had earlier refused to consider a separate case stemming from a jury's decision that Microsoft should pay $521 million for infringing patents held by Eolas Technologies Inc. and the University of California. Microsoft challenged a ruling that the award should be based on worldwide sales rather than domestic
sales."
