In the publishing world, the publisher virtually always makes the author responsible for copyright violations. This is done by contract. The author contacts libraries and other publishers and negotiates a fee or arrangement that is usually tied to the initial number of printed copies. From a business mans perspective, the is true for software code. It is a form of writing after all.

Fair use doctrins would also apply. This allows say a teacher to copy material for a class and distribute it. If the class is held regularly then the teacher is expected to contact the publisher for permision. Often there is no fee, just a statement that such and such comes from so and so. It is advertisement for so and so really.

On ocasions the teacher is not given permision. All that means is that the favored print material can no longer be used. But there are always alternative materials from other publishers that cover the same ground. In all the years of humanity and original though or concept is so unlikely.

What this article and Blog are demonstrating is the rise of inhouse programmers and a change in the cost dynamic from vendor to inhouse. Its the Buy vs Build debate where Buy looks to be highly unfavorable for a well managed organization.
