The GPL (and many other Open Source licenses) are granting developers/users access to code that is protected under Copywrite. If you make changes to the code 9and the code belongs to someone else) without getting a license, it is called infingement and can result in heavy fines. All the GPL does is grant access and (developer) usage to the Copywrited code.

There are other licenses that grant you access to code but many (most) do support the constraints of Copywrite Law (or other aspects of Intellectual Property Law). The BSD license is a little more commercially friendly (BSD is basis for IPSO in Nokia devices and the OS used in IronPort devices, among others) and that license does not require redistribution of the modifications.

Either way, you are bound by a license and can be taken to court if you fail to abide by them.
