Replication of ideas has always occured. Businesses always do that. Take fast food as an example. One restaurant comes up with beefy southwest chili buger. Next you will see all the competition coming out with some sort of southwest flavour of thier own to compete. Now had thier been burger patents that would be illegal.

So like software if come up with the next big thing in software there will a dozen other making similiar products that will have an edge to compete with me. This the nature of competition. Patents stop competition and that stifles innovation. Now there may be value to doing that but not with software with the current set up. If people want software patents, not they are needed, we should set them up to work with software lifespans. 5 years can see a radical change in how everything is done so I'd say software patents need to last less than 5 years. This isn't like devloping a new drug and having it take 10 years to get in to the market. You develope software and if you don't have it out with in a few years you sink. It seems the only ones that can get away with no releasing software every other year is Microsoft but they get that from thier Monopoly.
