I don't see the problem here
If one spends R&D on an idea and come out with a product that makes them a profit. Then someone else manages to create an entirely different but equally reliable set of code to do that same function but manages to do so by spending less on R&D then by all means they should profit by doing so.

It's no different than if I set up business and spend a lot money doing so and some other business does it for half the cost and under-cuts me. That's just how things work. If someone comes up with a better way to do it cheaper then they deserve the rewards.

Locking out competition so that the first maybe poorly implemented idea makes all the profit does not fuel innovation. It does the opposite.
