US Patant Law was designed to specifically deny that. That's the reason behind requiring a practical embodiment of the idea.

If I can "teach" my "giraffes to dance" without software, does that mean your "software" still needs protection?

It's quite a marginal argument that methods and algorithms need patent protection as these are much better protected by trade secrets and copyright. It's absolutely ridiculous to claim that data structures and protocols require patent protection as these are conventions, not inventions.
