Any elected official that has to structure in plausible deniability to allow "necessary" decisions he doesn't want to take the blame (or credit) for deserves to be run out of office on a rail, as it is the supreme act of political cowardice. We have a lot of such plausible deniability in the US Congress, but that's the major thing wrong with the US political system today.

Besides, as others have already commented, it is highly debatable whether software patents are necessary for a commercial software industry; there was one before software patents were widespread. Best argument you can make is that barriers to entry are too low to make commericial software profitable in the long term, but even that would be suspect (after all, companies are making money now).
