Susceptible to proof.
The short form.

Software is an IP industry. That means people are buying ideas, as implemented.

If any competitor could take the ideas that provide value, then that value would be reduced substantially.


Theft of the idea does not have to be in the same form as the original.
In the movies, as Roger Corman demonstrated frequently, reusing a plot or situation does not displace the original expression of the idea.
But in software, the same idea could be replicated in a different language for a different purpose, and the idea would still be stolen and the value reduced.

Also, ideas can be disseminated without specifics, as shown often in history.
If reliable news appeared that someone had written a program that allowed giraffes to dance, even if the code remained secret there would be a giraffe chorus line in Paris shortly after.
So even keeping code secret would not be sufficient protection.
