There is no loss that can be proven.

For example: If Britney Spears' new song is download for nothing or record off the radio for nothing what's the differnce?

This is problem of an outdated business model. The business model is the business of being middlemen. Now there is nothing wrong with being the middleman if you business model supports that but in this case it isn't.

The model of having a Recording Label promote music by paying millions of dollars to corporate radio stations is not sustainable. As much as the radio station and independent record promoters would like that this business model is on the way out. The Recording Label can still exist but thier business model must change to. They must become more service oriented and appeal to thier customers that being the artists who wish to sell to the masses.

Fileswapping leading to copyright infringment is the problem it's symptom of the actual problem. It seems easier to treat the symptom than the real problem but it only give you short term relief before the problem rears it's ugly head again in differnt form.
