Yeah, because MS is obviously worried about being back in court.
Microsoft has been lobbying heavily since the EU decision. They've obviously been able to buy off enough politicians. No one handling the case and certainly no one in the Bush Administration cares. They see $$ and it's all good.

Microsoft has a free pass to do whatever they want in the U.S., they've shown that.
