The issue is...
these protocols are not documented so other systems can
inter-operate. Samba has done an excellent job reverse-
engineering a number of these protocols but not all (eg full
Active Directory support is not available in Samba 3).

The EU argument is MS should make these specifications
available because of their near monopoly on the desktop.
They argue (and their position is supported by Article 82 of
the Treaty) third parties should be able to develop servers
with the same level of inter-operability with windows
desktops as MS, or they are unfairly disadvantaged and
competition is restricted.
