Stability is key issue here
Stability in a legal sense and for the future is the key issue here with the Linux kernel. Linus did the right thing by freezing the license to GPLv2 on the kernel. This keeps egos and personal issues out of everything. And quite frankly, I was very happy with GPLv2 myself. I dont think GPLv3 was necessary at all. And I think Linus was 100% correct in saying that GPLv3 crosses the line between governing software and the hardware it runs on. Linus is truly a visionary.
