Releasing proper documentation/specs for the hardware doesn't mean open-sourcing it. There are hundreds of devices that do this without issue at all. The only real ones that don't are nVidia and ATI. Even Intel gives proper docs/specs for their graphics chipsets and provides open source drivers.

Both companies provides open source code for the 2D parts of their cards, it is just the advanced 3D stuff they don't. All of the cards work well under the OSS drivers that exists, they just suck for 3D games.
